About The Pause On Oklahoma Cannabis Business Licenses

The Oklahoma Medical Marijuana Business Moratorium

In 2022, the state of Oklahoma declared a two-year moratorium on the processing as well as the issuance of new medical marijuana trade licenses for processors, dispensaries, and commercial growers of weed. The new ruling followed the passage of Cornwell and Paxton's HB 3208 in the state parliamentary body. This implies that Oklahoma will temporarily ban all applications for and issuance of cannabis business licenses for the duration of the moratorium.

The legislation was thought to go into force on August 1, 2022, and last until August 1, 2024. However, the ban was supposed to start on August 26, 2022, according to an announcement from the Oklahoma Medical Marijuana Authority (OMMA), which they alleged to be a misinterpretation. This moratorium was one of the steps OMMA was taking to keep up with the evolving cannabis laws and operations in Oklahoma.

What Is A Moratorium?

Any activity is temporarily prohibited under a moratorium. In the case of House Bill 3208, an application for a cannabis business license in Oklahoma has been suspended. In Oklahoma, it is currently not possible to apply for a cannabis business license as of August 2022. There is a possibility that the ban will be lifted earlier than its scheduled end date of August 1, 2024, which is when it will last for roughly two full years.

What Informed The Moratorium?

The moratorium aims to make sure that all cannabis-related activities and companies are carried out in accordance with state rules. The adaptable medicinal marijuana law in Oklahoma created opportunities for illegal activity, such as cannabis growers evading taxes. Therefore, this moratorium gives OMMA the opportunity to slow down some of these actions and come up with solutions to bring the sector into conformity.

Dispensaries, processors, and industrial growers who currently hold licenses can keep operating their enterprises. Additionally, OMMA will keep processing licenses that were requested before August 2022. The bill won't apply if a medicinal marijuana company's license is renewed.

Processors, dispensaries, and commercial producers that seek to relocate or change ownership owing to an allegation of business misconduct will not, however, be granted licenses by OMMA.

The bill includes a provision that allows the moratorium to end earlier, even if it has a set start and end date. If the Authority's Executive Director is confident that all reviews have been completed and the unlawful problems have been resolved, the moratorium may be lifted at any moment before the indicated expiration date. We may anticipate applications for cannabis company licenses in OK to reopen if this prohibition is lifted early.

Since the ban does not specifically target medical marijuana company licenses, it has no impact on any patients who use cannabis for medical purposes. So long as you possess an Oklahoma medical marijuana card, it is still permissible to purchase medicinal cannabis products online or from a dispensary.

Final Word

The implications of this moratorium on the medical cannabis sector remain to be seen. Will it have any impact on Oklahoma's economy? There are still many things to consider regarding the legalization of recreational cannabis in Oklahoma, which the majority of people are researching.
